The position of maternal guarantee from the perspective of normativism-functionalism

Abstract

The present work aims to discuss the role of the guarantor for female parents from a normative functionalist perspective, with a view to overcoming some of the difficulties posed by approaches based purely onphenomenological data –deriving
from causalist dogma theoretical frameworks, which is still backed by a significant part of our jurisprudence.
