Abstract
This article aims to analyze the criteria of the Supreme Court of Justice of the Nation regarding the expulsion of irregular
migrants based on the Huang ruling. Based on the analysis of the aforementioned case, it will allow us to understand the position of the highest judicial body on the recognition or not of the right to remain of foreigners whose entry into the country was irregular. Finally, it will be analyzed if the criterion adopted by the Supreme Court of Justice of the Nation in the aforementioned case complies with the human rights standards required by the guarantee of due process.
