Abstract
The global pandemic caused by the SARS-CoV-2 virus even today continues to generate a power struggle between the interests of the State aimed at protecting society in general as a whole and the rights and guarantees of individuals who make it up. Is the amparo action for effective judicial protection against State advances? To what extent can this “Leviathan” State restrict or limit individual freedoms based on a higher interest such as public health? Amparo action or declaration of unconstitutionality?
