Abstract

This research will present the perpetuity of the Being of consciousness in the literary work created by influence or plagiarism. We will proceed to state what the doctrine and national jurisprudence understand by originality. A comparative study will
be made between influence and plagiarism. Examples of the creative process of Jorge Luis Borges will be exposed. The studies on the phenomenology of Edmund Husserl made by academics and disciples will be synthetically analyzed. In the conclusion, an argument of the Being of the conscience in the existing objects will be proposed at the death of the contemplator.
